Disclaimer and terms of use

Applies to this application and to every application published by Stormberry AS.

What this is

This is a functioning prototype, published to show what Stormberry AS builds. It is not a certified instrument, not a professional service, and not a substitute for an authoritative source.

It is not a finished product, it is not maintained as one, and it will eventually stop working: data moves, interfaces change, and nothing here is kept in step with them. Its purpose is to show a potential use of AI, making a possibility visible quickly so it can be judged and then built properly if it is worth building.

It is offered in that spirit: real work, openly published, free to use, and carrying no promise beyond what is written below.

No professional engagement

This application is supplied free of charge as a demonstration of Stormberry AS's technical work. Downloading, installing or using it does not create a client, advisory, consulting or contractual relationship with Stormberry AS, and does not entitle you to support, maintenance or any service.

Nothing this application produces is professional advice. It is not navigational, maritime, meteorological, medical, engineering, financial, legal, tax or safety advice, and it must not be relied upon as any of those.

If you want professional advice from Stormberry AS, engage us. That is a separate matter with its own written agreement, and this is not it.

Specific to TideTracker

Not for navigation. Tidal figures are astronomical calculations and exclude meteorological effects, storm surge, local harbour geometry and river flow, any of which can shift real water levels substantially. For navigation, mooring or any activity on or near the water, use official tide tables from Kartverket or your national hydrographic office.

No warranty

The application is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. This restates and supplements the warranty disclaimer in the MIT licence under which the source code is published.

Stormberry AS does not warrant that the application is accurate, complete, current, uninterrupted, error-free, or that it will continue to be available at all. It may be changed, withdrawn or discontinued at any time and without notice.

Accuracy, and the limits of a calculation

Values shown are computed, estimated, modelled or simulated. They are not measurements, and they are not sourced from an official provider unless the application says so explicitly and names it.

Astronomical and tidal figures are calculations from published algorithms and carry the error of those algorithms and of the input data. Local conditions, terrain, weather, atmospheric refraction, harbour geometry and human error can all make reality differ from what is displayed.

Check anything that matters against an authoritative source before you act on it.

Not for safety-critical or operational use

This application must not be used for navigation, aviation, maritime or offshore operations, emergency planning, medical or clinical purposes, industrial or engineering control, legal or regulatory compliance, or any other purpose where an error could cause injury, loss of life, environmental harm, or significant financial or legal consequence.

Where an official source exists, use it. For tides and navigation that means the Norwegian Mapping Authority (Kartverket) or the relevant national hydrographic office. For weather, the national meteorological service. For space weather, NOAA SWPC or an equivalent body.

Costs are yours

The application is supplied free of charge. Stormberry AS charges nothing for it, receives nothing for it, and therefore refunds nothing for it.

Stormberry AS will not reimburse any cost, expense or loss you incur in connection with the application, whatever its cause. That includes, without limitation: travel, accommodation, transport and fuel; missed appointments, flights, sailings, deliveries or deadlines; missed or late alarms and the consequences of oversleeping; equipment, hardware, materials or installation costs; energy purchases or savings that did not materialise; lost income, lost profit, lost data, lost opportunity, or damage to reputation; and any third-party claim arising from your use of it.

You choose to use it. The costs of that choice are yours.

Limitation of liability

To the fullest extent permitted by law, Stormberry AS and its officers and personnel are not liable for any direct, indirect, incidental, special, consequential, punitive or exemplary loss or damage arising out of or in connection with the application or its use, or the inability to use it, whether in contract, tort (including negligence), strict liability or otherwise, and even if advised of the possibility of such loss.

Nothing in this document excludes or limits liability which cannot lawfully be excluded or limited. Under Norwegian law that includes liability for death or personal injury caused by negligence, and liability for gross negligence or intentional misconduct. Where any provision here is held unenforceable, the remainder continues in force.

Third-party and user-submitted content

Where an application displays data submitted by other users or obtained from a third party, Stormberry AS does not verify it, does not endorse it, and is not responsible for its accuracy, legality or completeness.

Your responsibility

You are responsible for deciding whether the application is suitable for what you intend to do with it, for verifying anything important against an authoritative source, and for complying with the law where you are.

Governing law

Norwegian law governs this document and any dispute arising from the application.
